Understanding equitable distribution in divorce
April 22 · 6 min read

What courts actually divide
Equitable distribution begins with classification: separating marital property from what each spouse brought into the marriage or received individually. Only after that inventory is complete does the court weigh how the marital estate should be divided.
Judges consider the length of the marriage, each spouse’s earning capacity, contributions as a homemaker or caregiver, and the practical needs of children. Understanding these factors early helps set realistic expectations before negotiations begin.
